Q: Is There an attorney representing the other side when you and your social security attorney present your disability case at a hearing?
A: A social security disability hearing is different than a typical trial you see in a courtroom. If you have a social security attorney, he or she will be present. But, unlike a typical courtroom trial, there is not an attorney that represents the other side (Social Security). Your social security attorney will help you provide your testimony, but there will not be another lawyer to cross examine you or ask you additional questions. Unlike other trials, the purpose is not to demonstrate which side is more just. The judge is there to make sure he or she understands your case, the circumstances around your injury or condition, how that affects your outlook for employment and whether you should be awarded disability insurance. Your social security attorney will walk you through everything before your hearing so you are prepared and feel confident. But you should make sure to be mentally prepared. Map out the route you plan to take on the day of your scheduled hearing. Many claimants even drive the route a few days before to make sure they know how much time to allow. You want to arrive on time to your hearing. And do not miss your scheduled hearing, unless it is an emergency. If you oversleep or forget about your hearing, the judge may not grant you another date. If you have a legitimate reason, your date can usually be rescheduled. Call your social security attorney immediately if an emergency arises on your scheduled hearing date. And if you know now that you cannot make the date for which your hearing is currently scheduled, have your social security attorney reschedule it with the hearing office now. A social security disability hearing is much less formal than a typical hearing. That being said, you need to make sure you dress appropriately and are courteous and polite just as you would for any hearing. Get plenty of rest the night before and be well groomed. Be honest and straight forward during the hearing. The truth is always the best policy. Walk through some sample questions and answers with your social security attorney ahead of time, so you will not be nervous about the process or what type of questions you will asked.
